Understanding Maryland’s Wiretap Statute

Maryland is one of the few states in the U.S. that requires the consent of all parties to lawfully record a private conversation. Under MD Criminal Law § 1-203, it is a felony offense to willfully intercept or record any wire, oral, or electronic communication unless all parties have given prior consent.

The term “interception” applies broadly and includes audio recordings made during in-person meetings, over the phone, or using hidden surveillance devices.

  • Recording with the consent of all parties involved
  • Recording in public meetings where there is no expectation of privacy
  • Law enforcement activity conducted under a valid wiretap order
